Terms of Service

1. Scope and Contracting Party

These Terms of Service apply to the use of the website shelto.app and the mobile app "Shelto" (iOS and Android), operated by:

By registering or using the services, you accept these Terms. If you do not agree, you may not use the services.

2. Service Description

Shelto is a platform for route planning, navigation, and discovering places for cyclists and outdoor enthusiasts:

  • Route planning and GPS navigation (App)
  • Storage and management of routes and collections
  • Community features (comments, ratings, photos)
  • Route export to external devices (Garmin, Wahoo, Hammerhead)
  • Optional premium subscriptions (Supporter/Pro)
  • Web-based route viewing and planning

Feature availability may vary depending on the platform and chosen subscription.

3. Minimum Age and Registration

Minimum age: 16 years

Use of the services requires a minimum age of 16 years. Persons under 16 may only use the services with explicit consent from a parent or guardian.

During registration, you must provide truthful information. Each user may only maintain one account. Login credentials must be kept confidential.

4. Subscriptions and Payment Terms

4.1 Free Use

The basic version is free to use with limited functionality.

4.2 Premium Subscriptions (App)

  • Supporter: Extended features for casual users
  • Supporter Pro: Full functionality for power users

Current prices are displayed before completing a subscription in the respective App Store.

4.3 Payment Processing

Payment processing is handled exclusively through the Apple App Store (iOS) or Google Play Store (Android). The respective payment terms of each store apply.

4.4 Automatic Renewal

Subscriptions automatically renew for the respective period unless cancelled at least 24 hours before the end of the current period.

4.5 Cancellation

Subscription cancellation is done through:

  • iOS: Settings → Apple ID → Subscriptions
  • Android: Google Play Store → Subscriptions

After cancellation, access to premium features remains until the end of the paid period.

5. Right of Withdrawal (EU Consumers)

Withdrawal Policy

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date of contract conclusion.

To exercise your right of withdrawal, you must inform us (Stansday UG, Oberer Kolberg 12, 34212 Melsungen, Germany, Email: support@shelto.de) of your decision to withdraw by an unequivocal statement.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days.

Note: The right of withdrawal expires prematurely if we have begun performance after you expressly agreed and acknowledged that you lose your right of withdrawal upon commencement of performance.

6. Usage Rights and Licenses

6.1 License to Use

We grant you a non-exclusive, non-transferable, revocable license for personal, non-commercial use.

6.2 Prohibited Use

It is prohibited to:

  • Decompile, reverse engineer, or extract the source code
  • Modify the services, create derivative works, or distribute them
  • Use the services for unlawful purposes
  • Perform automated access (bots, scrapers)
  • Harass, threaten, or discriminate against other users
  • Publish false or misleading information

7. User Generated Content

7.1 Responsibility for Content

You are responsible for all content you publish. You represent that:

  • You have the necessary rights to the content
  • The content does not infringe third-party rights
  • The content is not unlawful or objectionable

7.2 License Grant

By uploading content, you grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, and distribute this content within our services.

7.3 Moderation

We reserve the right to remove content without prior notice that violates these Terms or applicable law.

8. Data Sources (Maps and Weather)

Some geodata comes from OpenStreetMap (OSM) and is subject to the Open Database License (ODbL).

Weather data and warnings are based on open data from Deutscher Wetterdienst (DWD, licensed CC BY 4.0) and the Copernicus Atmosphere Monitoring Service (CAMS). Contains modified Copernicus Atmosphere Monitoring Service information; neither the European Commission nor ECMWF is responsible for any use of this information. Displayed warnings are processed by us and do not constitute official DWD publications.

We do not guarantee the accuracy, completeness, or timeliness of geodata and weather data.

9. Navigation and Route Planning

Important notices:

  • We do not guarantee the accuracy or feasibility of suggested routes
  • Actual conditions on the ground may differ from calculated paths
  • Use of navigation is at your own risk
  • Users are responsible for complying with traffic regulations

10. Device Integration (Garmin, Wahoo, Hammerhead)

  • Data transmission is subject to the policies of these providers
  • We are not liable for the availability, security, or functionality of these third-party services
  • Connections can be disconnected at any time in the settings

11. Limitation of Liability

We are fully liable for damages arising from injury to life, body, or health, as well as for intent and gross negligence.

For slight negligence, we are only liable for breach of essential contractual obligations, limited to foreseeable, contract-typical damages.

Liability for lost profits, indirect damages, and data loss is excluded to the extent permitted by law.

12. Availability and Changes

We strive for high availability but cannot guarantee uninterrupted use.

We reserve the right to:

  • Change, expand, or discontinue the services at any time
  • Modify or remove individual features
  • Temporarily restrict operation for maintenance

13. Termination and Suspension

13.1 Termination by User

You can delete your account at any time in the app (Profile → Settings → Delete Account) or contact us by email.

13.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You provided false information during registration
  • You misuse the services
  • Legal reasons require it

14. Privacy

Information about the processing of your personal data can be found in our Privacy Policy.

15. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

16. Applicable Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, the mandatory consumer protection provisions of their country of residence additionally apply.

The place of jurisdiction for disputes with entrepreneurs is Melsungen, Germany.

17. Severability Clause

Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.

18. Changes to the Terms

We reserve the right to change these Terms. For material changes, we will notify you at least 30 days before they take effect via email or in-app notification.
